Article 1: Definitions and Company Details

  • Seller: Kraken Oceanic Street Food, established and operating as a fixed market stall in Amsterdam.
  • KVK Number: 42102070.
  • VAT Identification Number: NL005494910B72.
  • Customer: The natural person who purchases products or services from the Seller at the market.
  • Agreement: Any transaction, sale, or order concluded between the Seller and the Customer.

Article 2: Applicability

  • These general terms and conditions apply to all offers, orders, and purchases made at the Seller's market stall.

Article 3: Prices and Payment

  • All listed prices are in Euros (€) and include the statutory VAT (9% for food products).
  • Payment must be made immediately at the time of purchase via pin (debit card/credit card) or cash.
  • The Seller reserves the right to refuse €100, €200, and €500 banknotes for security reasons.

Article 4: Allergens and Cross-Contamination

  • Provision of Information: Information regarding allergens is available verbally upon request at the stall. The Customer is required to disclose any severe allergies or dietary restrictions before placing an order.
  • Cross-Contamination: Due to the limited working space within the market stall, the Seller cannot guarantee the absolute absence of traces or cross-contamination of allergens (such as gluten, nuts, peanuts, or dairy) in freshly prepared foods.

Article 5: Immediate Consumption, Cancellation, and Risk

  • Immediate Consumption: Products are prepared for immediate consumption. The Seller is not liable for any loss of quality, spoilage, or health issues if the Customer chooses to store or consume the products at a later time.
  • Cancellation: Once the preparation of a custom or freshly prepared food item has begun, the purchase is final. Refunds or cancellations are not permitted.
  • Safety and Burns: The Customer is solely responsible for handling hot food and beverages with due care. The Seller is not liable for burns, spills, or damage to the clothing or property of the Customer or third parties after the physical handover of the product.

Article 6: Force Majeure and Market Regulations

  • The Seller operates in accordance with the Market Ordinance (Marktverordening) of the Municipality of Amsterdam (Gemeente Amsterdam).
  • In the event of force majeure, including extreme weather conditions, government measures, power failures at the market, or instructions from the market master (marktmeester), the Seller may alter opening hours or close the stall without any obligation to compensate the Customer.

Article 7: Liability

  • The Seller prepares all products in compliance with Dutch legislation and the HACCP guidelines of the Netherlands Food and Consumer Product Safety Authority (NVWA).
  • Except in cases of intent or gross negligence, the Seller's liability is strictly limited to the invoice amount of the specific purchase. The Seller is never liable for indirect damages.

Article 8: Applicable Law

  • All legal relationships between the Seller and the Customer are exclusively governed by Dutch law. Any disputes shall be submitted to the competent court in Amsterdam.
